Employers are required under section 26 3(b) of the Construction Industry Long Service Leave and Benefits Act 2005, to register with NT Build within one month of employing a registered construction worker.

In addition to be a registered employer, employers must ordinarily carry out or offer to carry out construction work for reward as part of their usual business.

No, there are no costs or charges to employers.

Employers are required under section 26 3(b) of the Construction Industry Long Service Leave and Benefits Act 2005, to register with NT Build within one month of employing a registered construction worker.

To register you will need to complete an Employer Registration Application Form and email it to info@ntbuild.com.au or post it to PO Box 36644, Winnellie NT 0820.

Once your registration has been approved, employers are required to:

  • keep adequate records to account for any eligible workers employed; and
  • complete an employer return twice a year advising NT Build of the number of days worked by each of their registered employees and any other information required by NT Build.

Please note:

  • Employer Returns are undertaken twice yearly (based on a financial year cycle).
    Period 1 is from 1 July to 31 December, usually issued mid to late January with a final lodgement date of 31 March,
  • Period 2 is from 1 Jan to 30 June, usually issued in mid to late July with a final lodgement date of 30 September; and
  • These requirements are legal obligations which may result in prosecution if not complied with

Section 10(3) Construction Industry Long Service Leave and Benefits Act 2005 provides that a registered employer may apply for a person to be registered as an employee under the Scheme. It is not mandatory, however it is considered good practice. If employers decide to apply for their employees to be registered they should make the affected employee/s aware of the application.

As part of the employer registration process, you will be provided with an employer registration ID and a temporary password. This information will enable you to access your employer account online, through the Employer Login portal. The first time you login, you will be prompted to re-set the password.

If you ever forget your chosen password, go to the Employer Login page and click on the “forgot your password” link. You will then be asked to enter your employer registration ID and the recorded email address. A temporary password will then be emailed to you. If you require assistance or are unable to retrieve your details, please contact NT Build on 1300 795 855.

The following days for which a registered worker or contractor is paid, counts as a qualifying service day:

  • a workday throughout which the worker carries out at least 6 hours of construction work during any work shift;
  • a public holiday or any day of paid absence for the worker, other than a day that is part of long service leave, while the worker is employed or engaged to carry out construction work in the Territory.

Every day a registered worker or registered contractor receives a workers compensation payment in respect of an approved worker compensation injury is also recognised as a day of qualifying service. For more information refer Policy No. 01-2011.

In circumstances where workers are employed on a Fly in Fly out / Rotating roster basis. An average number of days worked over the Return period should be used to calculate the workers service days. An average number of working days can be calculated using the following formula:

Total number of hours worked in Return period ÷ 8 (standard working day) = Service days for Return period

A worker is entitled to be credited with a maximum of 6 days of qualifying service per week, however they cannot accrue more than 220 days of service in a financial year.

If the employee has taken LSL with yourself as the employer under the Long Service Leave Act 1981, you are obligated under Section 98 of the Construction Industry Long Service leave and Benefits Act 2005 to advised NT Build as soon as possible.

Your NT Build account will be reduced by the equivalent amount of service that was paid to you by your employer. This avoids ‘double dipping’ which is prohibited under section 4 of the Construction Industry Long Service leave and Benefits Act 2005.

You will need to complete this form.

If you’re a registered employer without any eligible employed employees, please notify us via email info@ntbuild.com.au or call us on 1300 795 855. This will allow us to cease your registration or deregister your account, so you will not longer receive notifications from us to complete the returns.

If and when you do employer eligible employees again, we may be able to reinstate your account or you may be required to provide a Employer Registration Form in case your details have changed since you were last registered.
